Esteticium Australia Terms and Conditions

These terms and conditions ("Terms") govern your use of Esteticium Pty Ltd ("Esteticium Australia") services, website, and any related platforms. By engaging with Esteticium Australia or using our services, you agree to abide by these Terms. Please read them carefully before proceeding.

1.   Services Offered:

Esteticium Australia specialises in consultancy services, offering clients access to premium healthcare services at competitive rates for various medical treatments, procedures, or surgeries. Our comprehensive range of services includes:

·         Offering specialised advice regarding choices for medical procedures and treatments customised to meet individual needs.

·         Handling travel logistics, which may include accommodations and transportation.

·         Coordinating with world-class medical facilities and experienced professionals to ensure seamless care.

These services are designed to offer clients a hassle-free experience, guiding them through every step of their medical journey with professionalism and expertise.

2.   Entitlement to Fees

2.1  Esteticium Australia shall be entitled to a ‘deposit’ before scheduling any medical procedures, this amount may vary depending on your procedure associated with the agreement.  The final payment will be made directly to Esteticium Australia's clinical partner on the day prior to the scheduled procedure.

2.2  The client’s obligation to pay the deposit to Esteticium Australia is absolute under these terms and conditions and cannot be used as a legal or equitable setoff for any claim the client may have or allege against Esteticium Australia. 

3.   Terms of Payment

3.1  Upon agreement on the selected medical procedure, Esteticium Australia will issue an invoice to the client for a deposit.

3.2  Payments for deposits in full are due seven days from the date of the invoice.

4.   No Refund

4.1  In no circumstances, including but not limited to, if a client accepts the terms and conditions of a medical procedure, will the client be eligible for a refund of any fees paid to Esteticium Australia for the Consultancy Services.

5.   Client Responsibilities:

By engaging with Esteticium Australia, you agree to:

·         Provide accurate and complete information regarding your medical history, current health status, and treatment preferences.

·         Abide by the terms and conditions set forth by Esteticium and our partners, including medical facilities and service providers.

·         Comply with all legal and regulatory requirements related to medical tourism, travel, and healthcare.

6.   Clinical Partner's Responsibility

Esteticium Australia's clinical partners are responsible for performing medical procedures on clients. They accept accountability for any complications or issues that may arise during these procedures, within the bounds of factors they can reasonably control.

7.   Medical Procedures:

Esteticium Australia acts as a facilitator between clients and medical facilities. While we make every effort to connect clients with reputable medical professionals, we do not directly provide medical services. Clients undergo medical procedures at their own risk, and Esteticium Australia bears no liability for any medical outcomes or complications.

8.   Third-Party Providers:

Esteticium Australia partners with medical practitioners, hotels, and travel services to deliver our services. While we strive to ensure the accuracy and quality of information provided by third-party providers, we cannot guarantee their performance. Clients acknowledge that their information may be shared with these third-party providers as necessary to fulfill their requests.

9.   Confidentiality:

Esteticium Australia respects the confidentiality of client information and adheres to all applicable privacy laws and regulations. However, clients acknowledge that their information may be shared with third-party providers as outlined in our health/ medical privacy & confidentiality statement.

10.Limitation of Liability:

Esteticium Australia shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services or any interactions with third-party providers. Clients assume all risks associated with medical tourism and travel.

11.Indemnification:

Clients agree to indemnify and hold Esteticium Australia harmless from any claims, damages, liabilities, costs, or expenses arising from their use of our services, including but not limited to medical treatments and travel arrangements.

12.Governing Law and Dispute Resolution:

These Terms shall be governed by and construed in accordance with the laws of  Australian and New Zealand. Any disputes arising out of or relating to these Terms shall be resolved through arbitration in Australia or New Zealand under the rules of Australia or New Zealand.

13.Website

By accessing or using the Esteticium Australia website ("Website"), you agree to abide by these terms and conditions. If you do not agree with any part of these terms and conditions, you must not use our Website.

13.1               Intellectual Property

The content, design, graphics, logos, and other materials displayed on our Website are owned by Esteticium Pty Ltd ("Esteticium Australia") and are protected by intellectual property laws.
